Future Arctic Rulemaking ItispossiblethatfutureoffshoreoilandgasexplorationanddrillingintheArcticregionwillrequire theCoastGuardtotakeregulatoryactiontoestablish exclusionaryzonestoprotectthesafetyandsecurity ofallusersofthemaritimedomain.Regulatoryaction inthiscontextmayhavesignifcantFirstAmendment implications. Inpublicforums,thegovernmentcanissuecontentneutraltime,place,andmannerrestrictionsthatare narrowlytailoredtoasignifcantgovernmentinterest.8IfCoastGuardactionisrequiredandauthorized, considerationshouldbegiventowhethertherestrictionsarereasonableandcontentneutral.9Assumptionsofbadintentforapublicassembly,withoutcredibleinformation,arenotlikelytobeareasonablebasis foranexclusionaryzone.10Restrictionsaregenerally contentneutraliftheywouldapplyequallyacrossall viewpoints. Regulations should also be tailored to allow the intendedaudienceoftheprotesttoreceivethemessage,concedingthatsomezones(suchasinconfned waterway)maypresentchallengesthatarepermissibleaslongastheimpactisminimalinrelationto overallsafetyconcerns. TheArcticisanextremelyharshanddynamicenvironmentthatpresentsmanyoperationalchallenges.
